Terms of Service

These terms govern your use of SnoutWare. By creating an account or using the service, you agree to them. If you are agreeing on behalf of an organization, you confirm you have authority to bind that organization.

The service

SnoutWare provides software for animal shelters and veterinary practices, including intake, adoption and foster workflows, records, and related tools. We may add, change, or remove features over time.

Accounts and eligibility

You are responsible for the accuracy of your account information, for keeping your login secure, and for activity under your account. You must be able to form a binding contract to use SnoutWare.

Acceptable use

You agree not to:

• Use the service to break the law or infringe anyone's rights.
• Upload malware or attempt to disrupt, probe, or gain unauthorized access to the service.
• Misuse personal data you access through the service, including any data about adopters or fosters.
• Resell or copy the service except as these terms allow.

Fees and payment

What you pay depends on the kind of organization you are. Current amounts are on our pricing page; this section describes when and how you are charged. All fees are collected through our payment processor.

Shelters and rescues. Two kinds of charge can appear on your account. A per-adoption fee is incurred only when an adoption is completed in the service, and it is charged after that adoption, never in advance of it. Fees incurred during a calendar month are aggregated into a single invoice for that month.

Some features may also be offered as an optional subscription. You are charged for one only if you choose to add it, and it is charged in advance for each billing period. Where a subscription is priced by how much you use it, the band that applies to you is visible in the service, and a change to it takes effect at your next renewal rather than during a period you have already begun. If you have not added an optional subscription, a month in which no adoption is completed costs nothing.

Adding staff, fosters, or board members does not change what you pay.

Veterinary practices. Access is a per-seat monthly subscription, charged in advance for each billing period. Where annual prepayment is offered, it is likewise charged in advance for the year.

Fees already charged are non-refundable except where required by law. We may change our prices with reasonable notice; a change to per-adoption fees applies only to adoptions completed after the notice period, and a change to any subscription applies from the next billing period.

Your data and privacy

How we handle personal data is described in our Privacy Policy. As between you and SnoutWare, the data your organization puts into the service remains yours; you grant us the permissions we need to host and operate the service on your behalf.

Intellectual property

SnoutWare and its software, branding, and content are owned by us and our licensors. These terms do not transfer any ownership in the service to you; you receive a limited right to use it while your account is active.

Disclaimers

The service is provided "as is" without warranties of any kind to the fullest extent allowed by law. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, SnoutWare is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

Indemnification

You agree to indemnify SnoutWare against claims arising from your misuse of the service or your violation of these terms or of applicable law.

Cancelling, and taking your data with you

You may cancel at any time by telling us. There is no minimum term, no notice period, and no cancellation fee. If you are a shelter or rescue, any adoption fees already incurred before you cancel appear on a final invoice, and any optional subscription you have added runs to the end of the period you have already paid for; nothing further is charged after that. If you are a veterinary practice, cancellation takes effect at the end of the billing period you have already paid for.

You can ask us for a complete export of your organization's records at any time, and we will provide it at no charge. That applies while you are a customer, while you are cancelling, and afterwards during the retention window described below. The export covers your organization's operational records, not only what is visible on screen.

We may suspend or terminate access for violations of these terms or for risk to the service. On termination, your data is handled per our Privacy Policy, including the deletion schedule described there: records are kept for a short restore window before they are permanently deleted, so a cancellation made in error can be undone.

Governing law and disputes

These terms, and any dispute arising from them, are governed by the law of the jurisdiction where SnoutWare is established. The specific governing law and the venue for resolving disputes will be confirmed before these terms take effect.

Changes to these terms

We may update these terms. When we make material changes, we will update the date above and, where appropriate, notify account holders.
